Acceptance of Terms
Order Form and Account Registrations
In consideration of your use of the Service, you agree to: (a) provide accurate and complete information about yourself (and others, as applicable) as requested in any account registration form, nomination form, competition entry and/or other similar forms (the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it accurate and complete. If Changemakers suspects that your Registration Data is inaccurate or incomplete, Changemakers may suspend or terminate your account.
Usernames and Passwords
You will receive a username and password upon completing the Service's account registration process. You will choose your username, based on some parameters, and a password will be provided to you, which you can then change. You are responsible for maintaining the confidentiality of the password and are fully responsible for all activities that occur under your username and password. Any username and password for your access to the Service shall be for your personal use only. You agree to (a) immediately notify Changemakers of any unauthorized use of your username or password and (b) ensure that you exit from your account at the end of each session.
Use of the Service
You agree that all information, data, text, software, music, sound, photographs, graphics, video, messages and other materials available via the Service ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means you are entirely responsible for all Content that you make available via the Service. Changemakers does not control the Content posted by third parties via the Service, and does not guarantee the accuracy, integrity or quality of such Content.
You understand that by using the Service you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Changemakers be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content. You are responsible for complying with all laws applicable to the Content you submit via the Service.
In addition, you represent and warrant that you will not use the Service to do any of the following:
- upload, post, transmit or otherwise make available:
- any Content that infringes, misappropriates or otherwise violates any patent, trademark, trade secret, copyright or other contractual or proprietary right of any party;
- any Content that is unlawful, threatening, abusive, harmful to minors (including any form of child pornography or indecent depictions of children), harassing, intimidating, tortuous, defamatory, vulgar, obscene, libelous, defamatory, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable;
- any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements, any private information of any third party, Content you did not create or Content that you did not have permission to post);
- any unsolicited communications or advertising not authorized by Changemakers, promotional materials or any other form of solicitation for any type of information; or
- any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- obtain any information or Content from the Service using any robot, spider, scraper or other automated means for any purpose;
- take any action that imposes or may impose, as determined in our sole discretion, an unreasonable or disproportionately large load on our IT infrastructure;
- intentionally or unintentionally violate any applicable local, state, national or international law;
- upload any Content other than those of a personal nature that:
- is of you and your friends,
- is taken by you or your friends, or
- is original art or animation created by you or your friends;
- impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity; or
- collect or store personal data, including email addresses or data about other users in connection with the prohibited activities described in this paragraph.
By posting Content to the Service, you authorize and direct Changemakers to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the Content on the Site.
The Service and the Content may include security components that permit digital materials to be protected and you agree that use of these materials is subject to usage rules set by Changemakers or the providers of the Content. You shall not attempt to override or circumvent any of the usage rules embedded in such security components.
The Service may contain, or third parties may provide via the Service, links to third party websites or resources. Changemakers has no control over such sites and resources, and you agree that Changemakers is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, services or other materials on or available from such sites or resources.
Changemakers may modify, discontinue or suspend any portion of the Service, temporarily or permanently at any time. Changemakers shall not be liable to you or to any third party for any modification, discontinuance or suspension of the Service.
The intention of Changemakers in requesting a content license is not to obtain ownership in any of your Content, but to be able to publish such content on the Site, to promote your Content, to promote Changemakers, and to promote, further, and better understand the field of social change.
Therefore, by submitting Content via the Service (the “Submitted Content”), you grant to Changemakers a nonexclusive, perpetual, irrevocable, fully-paid-up, royalty-free license to use, translate, reproduce, modify, publish, publicly distribute, import, publicly display, publicly perform, digitally perform, create derivative works of and otherwise use such Content (including any copyrights, trademarks or other intellectual property contained therein), and the right to sublicense the foregoing rights (through multiple tiers) to third parties, for only the following purposes: (i) operating the Service; (ii) promoting the Submitted Content; (iii) promoting Changemakers; (iii) promoting social change; (iv) furthering the field of social change; and (v) gaining better understanding the field of social change.
For greater certainty, Changemakers shall not have any other rights in or to the Submitted Content and in particular, shall not claim copyright, file trademark applications or file patent applications over or using the Submitted Content. YOU, OR THE OWNER (IF APPLICABLE), RETAINS OWNERSHIP AND ALL OTHER RIGHTS TO AND IN THE SUBMITTED CONTENT.
If you are not the owner of the Submitted Content, you represent and warrant that you have the authority to grant this License.
Ownership of the Service
Except for the Content submitted by users, the Service, including all Content and photographs displayed on the Service and all underlying software or technology used in connection with the Service, and all aspects thereof, including all copyrights, trademarks, and other intellectual property or proprietary rights therein, is owned by Changemakers or its licensors. You acknowledge that the Service, the Content and photos displayed on the Service and any underlying technology or software used in connection with the Service contain Changemakers’ proprietary information. You may not commercially exploit any part of the Service, including photographs, except as expressly permitted by Changemakers. “Changemakers,” “Ashoka” and “Everyone a Changemaker” are trademarks of Changemakers or its affiliates. All rights in the Service not expressly granted by Changemakers to you are retained by Changemakers.
Notice for Claims of Copyright Violations and Agent for Notice
If you are a copyright owner and have a good faith belief that any Content available through the Service infringes upon your copyrights, you may submit a copyright infringement notification to Changemakers pursuant to the Digital Millennium Copyright Act by providing Changemakers with the following information in writing:
- an electronic or physical signature of the copyright owner or the person authorized to act on behalf of the owner of the copyright interest;
- a description of the copyrighted work that you claim has been infringed;
- a description of where the material that you claim is infringing is located on the Site, with enough detail that we may find it on the Site;
- Your address, telephone number, and email address;
- a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Content and Warranty Disclaimer
Changemakers makes no representations that the Service is appropriate or available for use in locations other than the United States of America, from where it is controlled and offered by Changemakers. Those who access or use the Site from other jurisdictions are responsible for compliance with local law.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHANGEMAKERS, ITS PARTNERS, AFFILIATES, CONSULTANTS, SUPPLIERS OR PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, SPECIAL OR PUNITIVE DAMAGES (INCLUDING ANY DAMAGES RESULTING FROM LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION) ARISING FROM OR RELATING TO THE USE OR INABILITY TO USE THE SERVICE WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT SUCH PARTIES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE AGGREGATE LIABILITY OF CHANGEMAKERS TO YOU ARISING FROM OR RELATING TO THE SERVICE (REGARDLESS OF THE FORM OF ACTION OR CLAIM, E.G. CONTRACT, WARRANTY, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL THEORY) IS LIMITED TO $100. CHANGEMAKERS AND ITS PARTNERS, AFFILIATES, CONSULTANTS, SUPPLIERS OR PROVIDERS HAVE NO LIABILITY WHATSOEVER ARISING FROM THE SERVICE. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. IF YOUR USE OF THE SERVICE RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, CHANGEMAKERS IS NOT RESPONSIBLE FOR THOSE COSTS. Applicable law may not allow the exclusion or limitation of certain damages, so some of the above limitations and exclusions may not apply to you.
Compliance with Anti-Money Laundering Laws
Changemakers will not make any grant if it finds that to do so would be unlawful. This may prohibit awards in certain countries and/or to certain individuals or entities. All recipients will comply with anti-money laundering laws to the extent they are applicable to such recipients. No recipient will take any action that would cause Changemakers to violate any laws.
In order to view the Site, you affirm that you are over the age of 13, as the Service is not intended for children under 13. If you are under 13 years of age, then you are not authorized to use or view the Site.
You are solely responsible for your interactions with other Service users. We reserve the right, but have no obligation, to monitor disputes between you and other users. Notwithstanding the foregoing, Changemakers’ shall not be liable for any claims, damages or other losses arising out of any disputes between users.
If you are an employee of Changemakers or its affiliates, please note that other internal company policies apply to you related to employee use of company computer systems and networks.
Passive Information Collection; Cookies

Active Information Collection
In general, when you visit the Site you remain anonymous, but on some pages, you need to provide Personal Information to register, enter a competition, contact us, and conduct other activities and transactions via the Site. The types of Personal Information collected at the Site may include any or all of the following, depending on your activities on the Site: name, address, e-mail address, phone number, fax number, website, organization (including the organization’s name, website, phone number, and address), username, password, language, photograph and other Personal Information that you actively provide to us via the Site.
We also enable you to submit Personal Information about other people. For example, we request that you provide us with such information about individuals who you wish to nominate for a competition sponsored by Changemakers, or to use as references, or who may be interested in hearing about Changemakers. The following types of Personal Information may be collected about such persons: name, organization name, email address, phone number, city, and country.
Use of Personal Information
We use and disclose Personal Information to provide information about our organization, our competitions, or other issues of interest.
Except as provided herein, WE WILL NOT SELL ANY PERSONAL INFORMATION THAT YOU PROVIDE THROUGH THE SITE WITHOUT YOUR PRIOR WRITTEN CONSENT. We may use Personal Information that you provide to update you on our activities, let you know about new projects and competitions that we believe may be of interest to you, and contact you about the outcome of competitions. If you do not want to receive this information in the future, please contact us at [email protected]. You can also manage your communications preferences in your Changemakers.com user profile.
From time to time, we may share certain Personal Information with other non-profits to enable them to share information that may be of interest to you. If you do not want us to share Personal Information with these entities, please contact us at [email protected] and we will take reasonable measures to avoid sharing such information in the future. Please note that these other parties are sometimes independent from Changemakers, and if your information has already been shared with such parties and you wish to stop all communications from such parties and/or stop any use of the shared information by such parties, you will need to address such issues with them directly.
We may share Personal Information with our partners, affiliates, consultants, suppliers, and providers. We require that these entities keep your Personal Information confidential and only use your Personal Information to the extent necessary to perform their functions and not for any other purpose.
We may disclose Personal Information in response to legal process or when we believe in good faith that the law requires it, for example, in response to a court order, subpoena, or a law enforcement agency's request. We also reserve the right to disclose Personal Information to protect the security of the Site, and to protect ourselves and our partners, affiliates, consultants, suppliers, and providers against liability.
The Site is not directed to children and Changemakers does not knowingly solicit information from any child under the age of 13.
How You Can Access or Correct Your Information
If you are a registered user of the Site, you can access and correct certain Personal Information that we collect online and maintain by clicking on "sign in" and entering your username and password. If any errors in your Personal Information cannot be corrected by accessing your account or if you have other questions related to updating or changing your account information, please contact us using the contact information below. You may also contact us using the information below to ask us to remove your Personal Information from our records, electronic or otherwise.
Use of Anonymous Information
The Site's web servers collect anonymous logs during user visits to the Site. This information is used to create aggregate statistics, for example, when the Site is accessed, the pages which refer visitors to the Site, the type of web browsers visitors use, and which pages of the Site are viewed. These statistics help us understand how the Site is used and provide us with valuable information for improving the Site in the future. From time to time, we may share such aggregate, non-personally identifiable statistical information with advertisers and our partners, affiliates, consultants, suppliers, and providers. The type and amount of information we receive and store depends on how you use the Site. Changemakers tries very hard to protect our users' Personal Information. Though Changemakers strives to protect this information, no transmission of data is completely secure. Changemakers will not be liable under any circumstances for damages resulting from use of information collected from you or any other visitors to the Site. When you access your account information, we usually offer the use of a secure server. You should be aware that when you voluntarily disclose Personal Information via competition entries, messages, forums, postings, or in other areas of the Site, that information, along with any substantive information disclosed in your communication, can be collected and correlated and used by third parties and may result in unsolicited messages from other posters or third parties. Such activities are beyond the control of Changemakers. Please do not post any Personal Information on the Site that you expect to keep private.
Usernames and Passwords
It is your responsibility to safeguard any username or password that you have received in connection with the Site, and to notify us if you ever suspect that the security and confidentiality of such username or password has been compromised in any way. You are solely responsible for any use of the Site via your username and password.
Please note that third parties may also collect information about you, through cookies or other technologies, when you link to their websites through the Site. We do not monitor or control the information collection or privacy practices of these or any other third parties, and are not responsible for their practices or the content of their websites.
