T-Mobile Changemaker Challenge 2022 Terms & Conditions  

 

INTRODUCTION  

These Terms and Conditions (the “Terms”) apply to the T-Mobile Changemaker Challenge 2022 (the “Challenge”) created from a partnership between T-Mobile Foundation (the “Partner”) and Ashoka (collectively the “Challenge Partners”). 

  

DEFINITIONS  

“You” or “Your” refers to any individual that makes an eligible submission through the Service with the intention of participating in the Challenge. Within these Terms, "You” may also be referred to as “Applicant” or “Participant”.  

“Challenge Jury” refers to the individuals selected, in the sole discretion of the Challenge Partners, to judge the Entries, which may include Challenge Partner employees or members of their larger networks or others who are not employed by or otherwise affiliated with the Challenge Partners.  

“Applicant Information” refers to Personal Data and Sensitive Personal Data contained in an Applicant’s Entry or in a prospective Applicant’s proposed entry through the Service.  

“Entry” refers to any eligible submission made by an Applicant through the Service that contains relevant information, including Personal Data or Sensitive Personal Data, for the purposes of participating in the Challenge.  

“Personal Data” refers to any information that relates to an identified or identifiable natural person, including but not limited to the following categories of information: name, address, email address, age, social media handle, photographs, and contact information; organization (including the organization’s name, website, phone number, and address), fields of work, languages, and location; username and password; the results of any questionnaires that you respond to; and your personal interests. 

“Sensitive Personal Data” refers to Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetics, biometrics, health and disability information, immigration / refugee status and information regarding a person’s sex life or sexual orientation and how they gender identify.  

“Service” refers to T-Mobile Changemaker Challenge 2022, https://challenges.changemakers.com/challenge/tmochangemaker2022 hosted by WeChangers, and affiliated websites or services that are used and operated for the purpose of executing or administering the Program. 

  

DATA PROTECTION  

The information You submit through the Service will be held, used, and disclosed to others. When You submit Applicant Information to the Service, You are directing and consenting to it being submitted to each of T-Mobile Foundation (the sponsor of the Program), Ashoka (the administrator of the Program as well as other programs), and WeChangers (the host of the Service), for each of their use pursuant to their own privacy policy. Applicant Information will be accessible by Ashoka and Partner and the host of the Service (WeChangers).   

Please take note that:  

(A) Your username (which may be Your full name if You elected to use it to create Your username), profile photo, city and state and the identity of other communities at changemakers.com that You are a member of may be visible to other Applicants at the Program Community space; and  

(B) Your username, the cover image for Your project, Your profile photo, Your project title, summary, sector, theme, focus, stage, URL, social media handles, location of impact and other information about Your project that You add in Your application’s "About Your Project" form will be visible by other Applicants, as well as by the general public.   

Exclusively in the review phase, in order to evaluate Your Entry, the Challenge Jury for all review phases and the peers joining community review activities will have access to the information described in (A) and (B) above, as well as to Your pitch video, if You submit one on the Service.   

For some of the information described in (A) and (B) above, You can control whether that information is viewable by other Applicants and the general public in Your account settings by logging in into the Program platform, accessing the community and going to "Settings" in the user menu. Your username, “About Your Project” narrative, and Cover Image will be viewable by other Applicants and the general public and You will not be able to modify the “Settings” on these items.

Each of the Challenge Partners may share Your information with its third-party service providers exclusively for purposes related to the Challenge You applied to, or as otherwise provided in the Challenge Partners’ posted privacy policy. To the extent permitted by applicable law, under Your explicit consent, Ashoka may use Your information to send you communications related to the Challenge (including future year’s programs or related alumni events), Ashoka initiatives similar to the Program, funding opportunities that come through partners and universities, media opportunities with key thought leaders, and scholarship opportunities from within Ashoka’s network. If you explicitly choose so, T-Mobile Foundation, or its third-party service providers acting on its behalf, may also contact You, or your parent or guardian, after the Challenge to notify You of future opportunities offered by T-Mobile Foundation or alumni events related to the Challenge. Each Challenge Partner seeks to use reasonable measures to protect the Applicant Information within its own organization. Neither is responsible for the acts or omissions of the other, nor of WeChangers or of any other third party. 

Applicant Information will be held and processed by the Program Partners during the duration of the Program and may be retained by the Program Partners for as long as required or permitted under applicable laws. Applicants, and parents or guardians of Applicants, can request access to, modification of, or deletion of any of their Applicant Information, to the extent permissible under applicable data protection laws, by contacting Ashoka via email at [email protected].  

 

AGE REQUIREMENTS AND PARENT/GUARDIAN CONSENT  

The Program is open to individuals who are between the ages of 13 and 18 when applying, and not older than 18 by the end of Entry period March 31st, 2022. This age requirement supersedes any contradictory age requirement set forth in the Ashoka Terms of Service or WeChangers Terms of Service.   

No Applicant shall submit an Entry until their parent or legal guardian has consented to the submission of their Entry and reviewed these Terms, Ashoka’s Changemakers’ Privacy Policy at https://www.changemakers.com/privacy-policy and WeChangers’ Privacy Policy at https://wechangers.org/en/pages/privacy . By submitting an Entry, You affirmatively state that Your parent or guardian has provided such consent and that You have provided an accurate email address for the Program Partners to contact Your parent or guardian. As part of the application process, the Program Partners will contact Your parent or guardian by email to inform them of Your Entry and provide additional information about the Program and the Terms and Conditions which You have agreed to as part of Your Entry into the Program. 

 

PARTICIPATION REQUIREMENTS AND AGREEMENTS  

Participant must be at least 13 when applying and not older than 18 by the end of entry period. A resident of the United States or Puerto Rico. Entries must be submitted in English and an Applicant is not allowed to submit more than one application. Parent or guardian consent is mandatory to participate in the Challenge. 

By submitting an Entry, the Applicant agrees to be bound by these Terms and by the decisions of the Challenge Partners, which are final and binding on all matters pertaining to the Challenge. Prizes are awarded in the sole discretion of the Challenge Partners and without warranty of any kind from the Challenge Partners or any of their affiliated companies, express or implied, without limitation, except where this would be contrary to applicable law or regulation.  

To the extent permitted by law, each Applicant agrees to hold the Challenge Partners, their subsidiaries, parents, agents, directors, officers, employees, representatives and assigns harmless from any injury, damage, expense, or loss caused or claimed to be caused by participation in the Challenge or use or acceptance of any Prize awarded, except to the extent that any death or personal injury is caused by the negligence of a Challenge Partner. The Challenge Partners are not responsible for any typographical or other error in the printing or posting of any materials related to the Challenge, in the administration of the Challenge or in any announcement relating to the Challenge. An Applicant may be prohibited from participating in the Challenge if, in the Challenge Partners’ sole discretion, they reasonably believe that the Applicant has attempted to undermine the legitimate operation of the Challenge, including by cheating, deception or other unfair practices or annoys, abuses, threatens or harasses any other Applicants, Challenge Partners, or their employees, agents or associated parties.  

To the maximum extent permitted by law, by submitting an Entry, each Applicant agrees to indemnify and hold harmless the Challenge Partners, their subsidiaries, parents, affiliates, agents, directors, officers, employees, representatives and assigns, at all times, from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Challenge Partners will or may become liable by reason of or related or incidental to any act, default or omission by an Applicant, including without limitation resulting from or in relation to any breach, non-observance, or act or omission whether negligent or otherwise, in contravention of these Terms by such Applicant.  

Employees of T-MOBILE USA, INC. or T-Mobile Puerto Rico, LLC, their parent companies, affiliates and subsidiaries, joint ventures, participating advertising and promotion agencies are only eligible to compete in the specific challenge in place for those individuals with formal ties to T-Mobile. One can apply for this challenge by selecting the option marked “Yes” for the question “Are you employed by T-Mobile or related to an employee of T-Mobile?” when completing the application. The eligible relationships to the T-Mobile employee are Parent/Guardian or Sibling. 

Employees (and their children and grandchildren) of Ashoka or any of their respective affiliates and participating advertising and promotion agencies are NOT eligible to apply to the Challenge. 

  

Challenge Prize Value  

The Partner will grant the Challenge Winner) (the “Winner(s)”) an investment of up to $15,000 USD as a prize (the “Prize”). The Challenge Jury may decide to award the Prize funds to more than one Winner. 

The value of each Winner’s Prize will then depend on its various merits and needs and will be determined at the sole discretion of the Challenge Jury.  

The receipt of the Prizes may be subject to different taxes, such as income tax, social security, and indirect taxes, depending on the Winner’s country of tax residence and the country where the Challenge is implemented. It is the Winner’s responsibility to comply with all applicable laws, including tax laws. In this respect, the Prizes granted as gross amount, and any applicable tax will be due and payable by the Winner, except if the applicable law explicitly provides for the liability of the donor. The Prize will be awarded in USD. All costs associated with currency exchange are the sole responsibility of the Winner. 

 

Challenge Award Use 

The Winner(s) agree(s) upon receipt of the Prize to use the funds exclusively to support the furtherance of the winning Entry and the purpose of the initiative as outlined in the Entry only. 

Following the awarding of the Prize, the Challenge Partners reserve the right to review documentation of the disbursements of the money paid to the winning Entry(ies). 

Winners agree to regular and appropriate monitoring and evaluations by the Challenge Partners, as well as to provide progress reports as may be required by the Challenge Partners. 

 

CHALLENGE PRIZES   

Each of the winners of the Challenge, as determined by the Challenge Partners in their sole discretion (the “Winner(s)”) will receive an investment, which may be up to $15,000, as a prize (the “Prize”) as described below.   

Early Entry Prize: All Participants with eligible Entries submitted by March 10, 2022 at 8PM PST will automatically be considered for an Early Entry Prize, and will receive Ashoka’s feedback on how to improve their application before the end of the overall Challenge application deadline March 31, 2022 at 9PM PST. Three (3) Participants from this group will be selected by the Program Partners to receive a $1,000 USD Early Entry Prize each.  

T-Mobile Changemaker Challenge 2022 Winners:   

Fifteen (15) final winners – 5 from each of the three categories (Digital Inclusion, Thriving Planet and Equity In Action). Each winning team will receive $5,000 seed funding and an all-expenses-paid trip to T-Mobile’s Bellevue, Washington, headquarters on July 25-27, 2022 (subject to change) for the Changemaker Lab, a three-day immersive experience. 

Three (3) teams, the best in each of the categories, will receive an additional $5,000 USD seed funding (for a total of $10,000 USD each) and the opportunity to pitch their project to senior leadership team members of T-Mobile and the T-Mobile Foundation.   

One (1) selected grand prize winner will receive an additional $5,000 USD in seed funding (for a total of $15,000) and a one-on-one meeting with an influential leader.  

From the T-Mobile Family Changemaker Challenge applicants, one (1) winning team will be selected. They will also be invited to the Changemaker Lab at T-Mobile headquarters and receive $5,000 USD seed funding.   

The sixteen (16) final Winners receive an invitation to participate in the Changemaker Lab (which is all-expense-paid trip for two (2) team members from each winning team and 1 parent/guardian (if a team member is under the age of eighteen (18)) to Bellevue, WA.  A minimum of one (1) team member of eligible age must attend the Changemaker Lab in its entirety to receive the seed funding. 

The Program Partners expressly reserve the right to make any changes to the Awards details described above in their sole and absolute discretion.  

All attendees, staff, and chaperones must be fully vaccinated to attend the Lab in person and proof will be required.  

In the event that circumstances necessitate canceling the in-person event, referred to above as the Changemaker Lab (as determined in the sole discretion of Ashoka and T-Mobile Foundation), a virtual event will be held and no all-expense paid trip will be provided to the Winners.  

The receipt of the Prizes may be subject to different taxes, such as income tax, social security, and indirect taxes. It is the Winner’s responsibility to comply with all applicable laws, including tax laws. Prizes will be granted as gross amounts, and any applicable tax will be due and payable by the Winner, except if applicable law explicitly provides for the withholding or other liability of the Program Partners with respect to the granting of such Prizes. All Prizes will be awarded only in USD.  

  

INTELLECTUAL PROPERTY   

Applicants who submit an Entry that contains the Applicant’s intellectual property retains their individual rights to their work and any derivative works.  

By submitting an Entry, You certify and warrant that Your Entry is original and that You are the sole and exclusive owner and right holder of the submitted Entry and that You have the right to submit the Entry for the Program. Further, You agree not to submit any Entry that (1) infringes any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in any jurisdiction in the world.   

By submitting copyrighted material, you certify that you have obtained the necessary permissions from the copyright owner in writing.  You assume responsibility for any associated penalties and costs incurred as a result of a copyright violation related to this material.  

Nothing in these Terms shall be considered or is intended to confer or transfer to a party any ownership right or interest in any intellectual property (such as trademark, design, symbol, etc.) of another party.   

 

COMMUNICATIONS RIGHTS  

These Terms grant the Program Partners the right to share Your Entry information (including without limitation Your name, likeness, and the name and details of Your project) that was submitted for public view with journalists, via social media, on Program Partners’ website, or in Program Partners’ publications. The Program Partners may use, reproduce, distribute, transcribe, translate, promote, broadcast, exhibit, publicly display material You have provided or made available for public use in Your Entry.  

  

JURISDICTION  

These Terms are subject to change at any time in the sole discretion of the Program Partners; any change will be published on Challenge page. The terms and administration of the Program will be governed by the laws of United States and the relevant court of Virginia shall have jurisdiction.  

NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in regard to the judgment of the Awards Jury are hereby excluded, and each Applicant expressly waives any and all such rights.
